Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Luxent website (the “Site”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
What these Terms cover
These Terms cover the Site only. Consulting engagements, managed services, and software licenses are governed by a separate written agreement — typically a master services agreement and a statement of work, or the applicable product license. Nothing on the Site, and nothing in these Terms, forms that agreement or modifies one already in place.
Use of the Site
You may view, download, and print Site content for your own internal business evaluation. You agree not to:
- Copy, republish, or redistribute Site content for commercial purposes without our written permission.
- Scrape, crawl, or harvest content or contact details by automated means, except by a search engine obeying our robots.txt.
- Probe, disrupt, or attempt to gain unauthorized access to the Site or its underlying systems.
- Submit false information, or use our forms to send unsolicited commercial messages.
Intellectual property
The Site and its content — text, graphics, layout, photography, and software — are owned by Luxent or its licensors and are protected by copyright and other intellectual-property laws. The Luxent name and logo, and our product names (including iQ CPQ, LiNK for Salesforce, and Rental & Lease), are trademarks of Luxent. All other marks appearing on the Site belong to their respective owners — NetSuite and Oracle are trademarks of Oracle Corporation; Salesforce and AppExchange are trademarks of Salesforce, Inc. Their appearance on the Site does not imply endorsement by those companies.
Products and downloads
Our NetSuite and Salesforce applications are licensed separately and are subject to their own license terms. Product descriptions, screenshots, and feature lists on the Site are provided for information only, may change, and are not a commitment to deliver any particular feature.
Submissions and feedback
If you send us questions, suggestions, or other feedback, you grant us a non-exclusive, royalty-free license to use it to improve our services, without obligation or compensation. Do not send us confidential information through the Site’s forms — use a signed non-disclosure agreement instead.
Third-party links and platforms
The Site links to third-party websites and platforms we do not control. We provide those links for convenience and are not responsible for their content, products, or privacy practices. Your use of a third-party site is governed by that site’s own terms.
No professional advice; no warranty
Content on the Site — including blog posts, guides, case studies, and pricing information — is general information, not professional, legal, accounting, or tax advice, and should not be relied on for a specific decision without engaging us or another qualified advisor. Results described in customer stories are those customers’ own and are not a prediction of your results.
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Luxent will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of your use of the Site. [Counsel to specify an aggregate liability cap and confirm the carve-outs required by applicable law.]
Indemnification
You agree to indemnify and hold Luxent harmless from claims and expenses arising out of your misuse of the Site or your breach of these Terms.
Privacy
Our Privacy Policy explains how we collect, use, and share information about you, and the choices available to you. It is incorporated into these Terms by reference.
Changes to the Site and these Terms
We may change the Site or these Terms at any time. When we revise these Terms we will update the date shown on this page, and continued use of the Site after a change means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. [Counsel to confirm venue, and whether arbitration or a jury-trial waiver should apply.]
